06/14/2010 How To Get Further Reductions
If your RP-525 from the Board of Assessment Review is not
as low as the amount you requested on your RP-524, you do
have the option of requesting further reductions in your
assessment.
There are two processes for you to consider pursuing. First,
you can file for a Small Claims Assessment Review with the
Allegany County Clerk between July 1st and July 30th. This
will cost you approximately $30. You do not need a lawyer
but it is highly recommended. You must complete Form
RPTL-730 (see button on left side of this page to download
form).
Second, you can file an Article 7 lawsuit against the Town.
The filing charge is around $300. You must have a lawyer
for this process. You must file your Article 7 lawsuit between
July 1st and July 30th with the Allegany County Clerk. Click

You can either do the SCAR hearing first and then pursue
the Article 7 lawsuit or go directly to the Article 7 lawsuit.
Generally, you will have far more success with an Article 7
lawsuit than you will at a SCAR hearing.
In either case, you should get a "licensed appraiser" to do an
appraisal on your property. Do not use a realtor because
their opinion doesn't count in these legal processes. A
licensed appraiser usually charges between $200 and $300.
Ensure that they split out building/improvements from the
land value and provide a grand total.
Provide that document to your attorney who will complete the
necessary paperwork.
You do not need to attend either of these legal processes if
you have an attorney. In fact, I would discourage your
attendance because the process is too personal and too
emotional for you as a property owner.
So, let's figure out if either of these steps make sense for you
to undertake. Quite frankly, the reduction in your assessed
value should at least cause you to break even on reduced
taxes under normal circumstances. So, here's a computation
model to help you with that determination.
Example:
Lawyer + Appraisal Cost Estimate - $1,000
Breakeven Assessment Reduction - $23,255
Tax Per $1,000 of Assessed Value - $43
$43 times $23.255 = $1,000
This means that if your cost of doing these legal processes
doesn't result in an comparable $43 per thousand of
assessed value reduction, then you should not do it.
However, if your probable reduction is going to cause you to
breakeven or better, then definitely do it.
